HYDERABAD: DGP K Aravinda Rao on Thursday equated his case with the one faced by chief secretary S V Prasad, a few months ago, and urged the central administrative tribunal (CAT) to dismiss the petition filed against him by home secretary P Gautam Kumar on the grounds that it was devoid of any merits.
Gautam Kumar described Aravinda's appointment as a violation of cadre rules and hence wanted the same to be nullified by the tribunal. Raghunandan, the counsel for Aravinda Rao, told the tribunal that as his client's appointment as the DGP of the state on August 31, 2010, he was a validly appointed DGP of the state and hence all contentions raised with regard to cadre and pay rules were invalid.
He also cited the case of chief secretary S V Prasad who also faced a similar challenge when he was made the chief secretary of the state in 2009. Prasad too was promoted to the CS grade when there were no vacancies in the grade and later his assent to the CS grade was upheld by the CAT, Raghunandan said. "Aravinda's case is exactly similar to that of SV Prasad and hence his appointment too deserves to be upheld," he said. The bench would hear the matter again on Friday.
